IMPORTANT: By creating an account, verifying your phone number, and viewing property listings on ForeclosuresDeals.com, you are entering into a binding Consulting and Referral Agreement. Please read these terms carefully before using the platform.

1. Acceptance of Terms

By creating an account on ForeclosuresDeals.com ("the Platform"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not create an account or use the Platform.

2. Account Registration

To access property listings, you must:

Create an account with your real name and email address
Verify your phone number via SMS verification code
Provide accurate information — false or misleading information is grounds for account termination
Explicitly agree to these Terms of Service by checking the "I Agree" checkbox

No credit card is required to create an account or browse listings. The Platform is free to search and set up alerts.

3. Consulting and Referral Agreement

This is the most important section of these Terms. Please read carefully.

By viewing any property listing on the Platform, you acknowledge and agree to the following:

Viewing any property listing on ForeclosuresDeals.com constitutes a binding referral and consulting agreement between you ("Buyer") and ForeclosuresDeals.com ("Consultant"). A consulting fee equal to 1% (one percent) of the final purchase price becomes due and payable at closing if the Buyer purchases the property, or any interest in the property, within 24 months of the date of first viewing, regardless of the method of purchase, the parties involved in the transaction, or whether Buyer uses a separate real estate agent, broker, or other intermediary.

This means:

If you view a property on our Platform and later purchase that property within 24 months, a 1% consulting fee is owed to ForeclosuresDeals.com
This applies regardless of whether you purchase through us, directly from the homeowner, through a realtor, at auction, through another service, or by any other means
The fee is due at the time of closing and is typically paid through the closing/title company
This agreement survives the termination or deletion of your account

4. Property Viewing Records and Tracking

To enforce the Consulting and Referral Agreement, the Platform maintains comprehensive records of all property viewing activity, including but not limited to:

Timestamped viewing records — the exact date and time you viewed each property listing
Verified identity — your name, email, and phone-verified identity
IP address — your internet protocol address at the time of viewing
Device fingerprint — unique identifiers associated with your device and browser
Interaction data — clicks, time spent, pages visited, and property-specific actions

These records serve as proof of introduction and referral in the event of a dispute. You acknowledge and consent to the collection and retention of this data for the purpose of enforcing these Terms.

5. Buyer Pre-Qualification Requirements

To make an offer on a property through the Platform, buyers should be prepared with:

A mortgage pre-approval letter from a licensed lender
A minimum down payment of 20-30% of the purchase price (20% minimum, 30% preferred — stronger offers get accepted faster)
Proof of funds for the down payment
Ability to close within 30-60 days

The Platform is designed for qualified, serious buyers. Having your pre-approval and down payment ready before browsing gives you the best chance of securing a deal.

6. Enforcement and Remedies

In the event that a Buyer purchases a property viewed on the Platform without paying the 1% consulting fee, ForeclosuresDeals.com reserves the right to:

Issue a formal demand letter for payment of the consulting fee
File a lien against the property for the amount of the unpaid consulting fee plus costs
Pursue legal action for breach of contract, including recovery of the consulting fee, interest, and reasonable attorney's fees
Report the unpaid obligation to credit reporting agencies

Property closings are a matter of public record. The Platform monitors deed recordings and cross-references new property owners against its user database to identify potential circumvention of the consulting agreement.

7. Property Information Disclaimer

Property listings on the Platform are compiled from public courthouse records and other publicly available sources. While we strive for accuracy, ForeclosuresDeals.com does not guarantee the accuracy, completeness, or timeliness of any property information. All property data is provided "as is" and buyers should conduct their own due diligence, including but not limited to: independent property appraisal, title search, home inspection, and legal review.

Estimated market values, discount percentages, and savings estimates are based on available data and are not appraisals. Actual market value may differ.

8. No Real Estate Brokerage

ForeclosuresDeals.com is a property information and consulting platform. We are not a licensed real estate brokerage, and we do not act as a real estate agent or broker for any party. The 1% consulting fee is for property identification, research, and consulting services — not for real estate brokerage services. Buyers are free to use their own licensed real estate agent at their own expense.

9. Email Alerts and Communications

By creating an account or signing up for alerts, you consent to receive email communications from ForeclosuresDeals.com regarding property matches, deal alerts, and platform updates. You can unsubscribe from marketing emails at any time. Transactional emails (account verification, security notices, legal notices) cannot be opted out of while your account is active.

10. Account Termination

You may delete your account at any time by contacting [email protected]. However, deletion of your account does not terminate the Consulting and Referral Agreement for properties already viewed. Viewing records and referral obligations survive account termination for the full 24-month period.

11. Prohibited Conduct

You agree not to:

Use false identity information to create an account
Create multiple accounts to circumvent these Terms
Scrape, copy, or redistribute property data from the Platform
Use the Platform to harass, threaten, or spam property owners
Attempt to circumvent the consulting fee by purchasing a viewed property through another party, entity, or intermediary
Use automated tools, bots, or scripts to access the Platform

12. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms or the use of the Platform shall be resolved in the courts of Palm Beach County, Florida.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email and a notice on the Platform. Continued use of the Platform after changes constitutes acceptance.
